No sir, that's called a refuted hypothesis.
He then simply would have to make a new hypothesis and run more tests to confirm.

Of course if it don't kill them then he just has to test more people (at least 60 data points) until he can be absolutely sure of what it does.

As long as he sticks to the scientific method then it's not bastard.
Plus I asked met before the game and he said that he would not use any false roles (Paranoid Sheriff, Doctor who kills people when told they heal, or Marshal that does nothing) or anything like that.
